Choice of transport mode
The choice of transport mode depends on the weight and packaging.
For in-stock products, any order placed before 1:00 PM Monday to Friday: delivery via FEDEX, within 24 hours the next day before 1 PM on weekdays, except in case of adverse weather, and the following Monday for Friday orders.
This transport mode is not a guaranteed express service. FEDEX offers additional services for delivery before 10 AM and Saturday delivery. If you are interested, please contact us for a quote.
Parcels over 30 kg are shipped via GEODIS, while La Poste and its partners are used for international shipments.
From the moment the goods are handed over to the carrier, responsibility for the equipment is transferred to the buyer. To ensure that any potential claim is handled, you must carefully follow these verification steps:
1. Immediate inspection in the presence of the driver
Do not sign the delivery note until you have checked:
- Packaging integrity: Is the box or pallet torn, wet or re-taped?
- Equipment conformity: Does the number of packages match the delivery note? Is the equipment intact?
2. Writing "specific reservations"
If you notice any damage, you must note it on the receipt and refuse the goods.
Warning: The mention "subject to unpacking" has no legal value. Your reservations must be specific (e.g.: "Ventilation housing dented", "Turbine blade bent", "1 package missing out of 3").
3. Refusal and notification within 48 hours
In case of unusable equipment, refuse the delivery. In all cases (refusal or acceptance with damage), you must:
- Take photos of the package and damage.
- Confirm your reservations in writing to the carrier within 48 hours.
- Immediately inform S.E.T.E.M customer service with supporting documents (photos, order number, delivery note).
Why is this mandatory?
In accordance with Article L.133-3 of the French Commercial Code, failure to comply with these formalities extinguishes all recourse against the carrier and S.E.T.E.M. Without this refusal, we will not be able to reship new equipment.
In case of damage
In case of damage, please send us photos of the contents and packaging as described below:
- Of the closed package showing the transport letter
- Of the opened package with the goods inside
- Of the opened and empty package
- Of the damaged goods
Equipment is neither taken back nor exchanged. Packaging and storage costs remain due.
Collection is possible directly from our counter, by appointment.

When you make a quote request, we only collect information strictly necessary for processing your request. This data includes:
- Your company name,
- Names and contact details of your commercial contacts,
- Billing and/or delivery address,
- Your bank details, when opening a credit line.

Order acceptance
Any order placed with S.E.T.E.M. implies the express, full and complete acceptance, without reservation, of these General Terms and Conditions of Sale.
Any general or specific conditions appearing on purchase orders or on any other document from the customer, contrary or derogatory to these, are deemed null and void, unless prior written acceptance from us.
Prices
Our prices are established on a personalised quote basis, according to your activity code, valid for a period of 1 month.
This approach allows us to offer you the best price based on the market and availability. After this 30-day period, an update may be necessary depending on fluctuations in raw material costs from our suppliers.
Prices are net, excluding taxes, and for cash payment, unless otherwise expressly agreed.
Deadlines
S.E.T.E.M undertakes to make its best efforts to ship any accepted order within the shortest possible time. However, the delivery times communicated are given for information purposes only, and their fulfilment depends in particular on sourcing from manufacturers or suppliers.
Consequently, any delay shall in no case justify the cancellation of the order, nor give rise to penalties, compensation or price revisions.
Delivery – Transfer of risks and claims
Goods are shipped from S.E.T.E.M warehouses to the address indicated by the customer at the time of order. From the moment they are handed over to the carrier, they travel at the buyer's risk, regardless of the shipping method or transport conditions.
Warranty conditions
Legal warranty – Hidden defects
In accordance with Article 1641 of the French Civil Code, S.E.T.E.M is bound by the legal warranty against hidden defects affecting the products sold, rendering them unfit for their intended use or so diminishing that use that the buyer would not have purchased them, or would have paid a lesser price, had they been known.
To be admissible, the defect must:
- be prior to the sale,
- not be apparent at the time of delivery,
- render the product unfit for its normal use or significantly diminish its use.
The buyer has a period of two (2) years from the discovery of the defect to take action, in accordance with Article 1648 of the French Civil Code.
In case of a recognised hidden defect, the buyer may choose to:
- either return the product and obtain a refund of the price,
- or keep the product and obtain a price reduction.
Warranty exclusions
The warranty does not cover:
- normal wear and tear of the product,
- defects resulting from misuse, non-compliant installation, insufficient maintenance or modification of the product,
- damage related to installation not in accordance with the manufacturer's recommendations,
- interventions carried out by an unauthorised third party.
Claims procedure
Any claim must be made in writing, accompanied by supporting documents (invoice, description of the defect, photos where applicable), as soon as possible after the defect is observed.
No return of goods can be accepted without prior written agreement from S.E.T.E.M.
Limitation of liability
S.E.T.E.M's liability is strictly limited, at its discretion, to the replacement, repair or refund of the product found to be defective.
Any refund can only be made after express validation by the manufacturer or factory, following a technical inspection confirming the existence of damage attributable to a product defect and prior to the sale.
No refund can be made until this inspection has been carried out and validated.
The buyer is expressly informed that inspection and diagnostic procedures may require significant lead times, depending in particular on the manufacturer, the type of equipment concerned and the nature of the defect observed.
Similarly, repair or replacement times may be variable and extended, without this engaging the liability of S.E.T.E.M.
Under no circumstances shall S.E.T.E.M be held liable for indirect damages, loss of business, loss of production, loss of profit or any other financial or commercial loss resulting from equipment downtime.
